Terms and Conditions for Creatives

These Terms and Conditions (“Agreement”) govern the relationship between CRTV (located in Amsterdam, Netherlands) and any individual signing up as an independent creative contractor (“Creative”). By engaging with CRTV, you agree to be bound by the following terms.

Services

Creatives engaged through CRTV are expected to deliver services such as videography, photography, or other creative work at a professional and acceptable quality in line with industry standards.

Compensation

Payment rates for each project will be agreed upon in advance and communicated clearly before work begins. Clients pay CRTV directly, and CRTV is responsible for disbursing funds to the Creative.

Expenses

Pre-approved project-related expenses (e.g., equipment rental, studio fees, travel necessary for service delivery) will be reimbursed according to prior written agreement.

• Projects above 1,000 EUR/GBP may include up to 5% of the fee as deductible travel expenses for reasonable travel requests, i.e. a taxi or train ticket. 

• Major travel (flights, accommodation) will be added on top of your service fee so you do not pay out of pocket.

Term and Termination

Engagement begins once a project is confirmed and remains in effect until completion, or until either party terminates in writing.

• Creatives must provide one month’s notice to terminate their collaboration with CRTV.

• Upon termination, all CRTV property (equipment, documentation, etc.) must be returned.

• Lost or damaged property must be reimbursed at market value unless agreed otherwise in writing.

Independent Contractor Status

Creatives are independent contractors and not employees of CRTV. As such:

• Creatives are responsible for their own taxes and insurances.

• Creatives may not represent themselves as agents of CRTV without explicit prior written permission.

Confidentiality

Creatives may be exposed to confidential information relating to CRTV projects, clients, and operations.

• Confidential information must not be used or disclosed without prior written consent.

• This obligation continues indefinitely, even after termination.

• Breaching confidentiality may result in legal action, including claims for damages and recovery of attorney fees.

Ownership of Work Product

Creative work produced under CRTV projects is considered joint property between CRTV and the Creative.

• CRTV reserves the right to use such work for portfolio, marketing, and promotional purposes.

• Portfolio items acquired through CRTV may remain on the CRTV site permanently.

• Portfolio items from the Creative prior to partnership may be displayed on CRTV for up to 6 months after termination as per written agreement, unless confirmed otherwise in writing.

Non-Solicitation

For 6 months after leaving CRTV, Creatives may not directly solicit or accept business from CRTV-acquired clients unless at least 3 projects have been completed through CRTV with that customer.

• Circumventing payment through CRTV will result in immediate termination and enforcement of the Ownership of Work Product clause of the contract.

Warranties

Both CRTV and Creatives warrant that they have the authority to enter into this Agreement. Creatives represent that they hold all required licenses, permits, or certifications needed for their services (e.g., drone certifications for aerial content).

Disputes

Disputes will first be handled through mediation. If resolution cannot be reached, CRTV reserves the right to terminate engagements where terms have been breached.

General Terms

• This Agreement is binding on both parties and their permitted successors.

• Amendments must be in writing and agreed upon by both parties.

• Notices may be delivered in person or via email.

• Waivers must be made explicitly in writing.

• If any part of this Agreement is invalid, the rest will remain enforceable.

• This document, together with any written agreements, constitutes the full and final understanding between the parties.
